On May 18, 2022, the U.S. Court of Appeals for the Second Circuit entertained oral argument in American Oversight v. DOJ, which concerns the propriety of DOJ’s use of Exemption 5 to withhold FBI interviews related to campaign finance investigation of Michael Cohen.
